NYC: More Herpes Circumcision Cases Since de Blasio Lifted Metzitzah B'Peh Regulations

No one wants to come right out and say it, because doing so gets you labeled an "anti-Semite," but a particularly Jewish tradition, specifically the ultra-orthodox Jewish tradition of sucking a child's freshly circumcised penis to "cleanse the wound," is resulting in the spread of herpes in infants.

No one wants to actually write a law against this, because no governing body wants to be the first to write a law that regulates Jewish practice.

Actually, not too long ago, the NYC Health Department tried to instate a mandate to regulate the practice of metzitzah b'peh, otherwise known as "oral suction."

The mandate, which was supposed to be a measure to protect further boys from being infected, was pretty much toothless to begin with, because all it did was require parents to sign a consent form before allowing a mohel to perform metztizah b’peh on their sons. Furthermore, there was no real penalty or consequences for mohels if they didn't comply.

Despite the mandate being essentially impotent, ultra-orthodox rabbis were intolerant of what they saw as an "unconstitutional, shocking governmental overreach," and they managed to convince NYC Mayor Bill de Blasio to lift the mandate. In exchange for this, however, the ultra-orthodox community vowed to report the cases of herpes that resulted due to metzitzah b'peh, and to name the mohels and rabbis involved as part of a deal.
According to a recent report, there have been six cases of infants contracting herpes as a result of the traditional practice of oral suction, since Mayor de Blasio decided to lift the previously instated mandate.

Two of the mohels involved remain a mystery despite the ultra-orthodox community's agreement to help the city identify, and isolate any mohels responsible for infecting infants with herpes through oral suction.

At least on paper, all cases of neonatal herpes are required to be reported to the city's Health Department shortly after they occur. In response to each case, health officials were supposed to issue a “health alert” notifying medical practitioners in an effort to educate them about the potential hazards of the practice.

It looks like this too, like the policy before it, was mere gesture to keep people happy.

I think the problem here is obvious.

Nobody is willing to call a spade a spade for fear of looking like "the bad guy."

Meanwhile, healthy children are getting infected with herpes, in some cases, resulting in death.

It really must be asked; when deciding these things, whose interests do people really have at heart?

Israel Ahead of New York in Recommending Against Metzitzah B'Peh



Following the deaths of two newborns as a direct result of herpes infection through metzitzah b'peh, an ultra-orthodox practice where a mohel sucks blood from the circumcision wound of a newly circumcised newborn, and the infection of several others, the New York City Health Department issued a mandate that would require parents to sign a consent form before allowing a mohel to perform metztizah b’peh on their sons, as a measure to protect further boys from being infected.

Had the measure actually been implemented, the health commission would have imposed penalties at its own discretion. They would respond to public complaints and investigate the claims, and that repercussions would have ranged from a phone call or a formal warning letter, to fines of up to $2,000 for each violation.

The mandate was more of a gesture, because there was no actual ban or regulation of metzitzah b'peh, and mohels would face no penalties whatsoever if the waivers were not signed.

Despite the mandate having been essentially impotent, ultra-orthodox rabbis were intolerant of what they saw as an "unconstitutional, shocking governmental overreach." Rabbi William Handler, leader of Traditional Bris Milah, a self-proclaimed group formed to “protect Jewish ritual circumcision,” declared this mandate to be "the first step in completely taking away traditional bris milah from the Jewish people in New York City.”

To prevent this mandate from taking effect, several rabbis and Jewish organizations, including Agudath Israel of America and the International Bris Association, filed a lawsuit at the Federal District Court in Manhattan. They accused mayor Bloomberg of "blood libel," and the New York City Health Department of "trying to enforce erroneous opinions on the people of New York City." They claim the city lacked “any definitive proof” that metzitzah b’peh “poses health risks of any kind," despite the fact that the CDC found a total of 11 baby Jewish boys in NYC were infected with herpes.

Concerned Rabbis kept fighting to push back the date of the regulation's actual implementation, and after much ado, NYC Mayor Bill de Blasio finally annulled the regulation enforced by the Bloomberg administration on the practice of Metzitzah B’peh last year.

Essentially, babies died of herpes infections, several others were infected, and it's as if nothing actually ever happened.

In Israel, on the other hand, the Israeli Health Ministry is planning to go as far and distribute a detailed document dealing with the risks and advantages of metzitsah b'peh to new parents.

According to the Jewish Press, many doctors say the practice increases by 350% the chance of infecting the newborn baby with herpes simplex.

Some members of the chief rabbinate were concerned that the move might harm mohels, the Jewish Press says.

And I ask, what, pray tell, about the babies?

Nonetheless, I must say, how interesting the turn of events. What the health ministry in New York couldn't do, they're actually doing in Israel.

While PACE Holds a Hearing on Circumcision, Another Baby Contracts Herpes in NYC

The Israeli Knesset's efforts to replace the recent resolution adopted by the Council of Europe, which calls the non-medical circumcision of minors a human rights violation, with their own, culminated in a parliamentary hearing, which took place in Strasbourg last week.

As part of their campaign, the Knesset produced a promotional film, which they aired at the PACE hearing, in hopes of getting their wish that the latest PACE resolution be replaced, vindicating the forced circumcision of healthy, non-consenting minors.

Meanwhile, in New York, yet another case of a baby contracting herpes after a traditional Jewish circumcision ritual, where a mohel sucks the wounded penis of a newly circumcised child (AKA, Metzitzah b'peh) makes the news. (Incidentally, the current mayor has shelved his promise to repeal the New York law that requires mohels to inform parents of the risks of Metzitzah for the time being.)

Those who support the current resolution also stated their case.

BUSTED: Agudath Israel of America's Antics Revealed


My suspicions concerning a "study" I talked about in my last post have been confirmed, thanks to the blog FailedMessiah.

Apparently both of the "researchers" at Penn Med Center for Evidence-based Practice, who wrote the "study" cited by ultra-orthodox Jewish group Adugath Israel of America in their attempts at repealing the New York law requiring mohels inform parents of the risks of metzitzah b'peh (AKA oral suction of a freshly circumcised baby's penis), both happen to be Orthodox Jews themselves, one of them being closely affiliated with the ultra-orthodox group Philadelphia Kollel.

The "study" was nothing more than an internal practice review, was never published, never peer-reviewed, and apparently was done in response to a request from Agudath Israel of America or one of their supporters.

The two professionals responsible for the "study," one an internist with no significant neonatal infectious disease experience, and the other health policy researcher who is not even a physician or an epidemiologist, did not declare their obvious conflict of interest.

Penn refuses to release the study to journalists, and even physicians and researchersthat have asked for it, but it was leaked none the less, and Failed Messiah got a copy.

In calling the "study" they cite to a Federal Court Judge "independent," and denying the true history of metzitzah b'peh and disease transmission, Adugath Israel is deliberately and blatantly lying.

For example, they cite the Talmud, as you can see in this excerpt from its appeals brief:


"One of the essential steps of the bris milah is metzitzah, during which suction is used to draw blood from the area around the wound. See Babylonian Talmud, Tractate Shabbat, at 133b. Traditionally, metzitzah is performed using oral suction, in a technique known as metzitzah b’'peh (“"MBP”"). Many prominent rabbinic authorities maintain that MBP is the proper, or even the only acceptable, way to fulfill the religious obligation. See SA 6-8."

The Talmud also makes it clear that that MBP is done for health reasons. As such, Jewish law should hold that MBP should not be done today because there is a large amount of evidence that it kills and maims babies, but Audath omits this from its brief.

"MBP is performed around the world, and has been safely practiced for millenia. Mohelim are carefully trained to ensure that MBP is performed in a safe manner. Among other precautions, mohelim do not perform circumcisions if they are exhibiting any symptoms of the herpes virus, such as cold sores; they minimize the duration of the contact, so that it lasts only approximately one second; and they generally precede the procedure by rinsing their mouths with an antiseptic, which in the case of mouthwash has been shown to eliminate the herpes virus in the saliva even of individuals exhibiting symptoms of a herpes infection. See SA 6-7 & 9 n.2; see also JA 19 (Berman Aff. ¶ 20)."

According to Failed Messiah, there is no organization that regulates mohels or supervises what they do. Some pick their noses and suck their fingers seconds before removing babies' foreskins; others wear gloves and have autoclaves to sterilize their instruments.

But quite possibly the biggest lie in Agudath's brief is that "MBP has been safely practiced for millenia."

In my last post, I point out that, according to Leonard Glick, author of "Marked in Your Flesh," metzitzah b'peh is actually a relatively recent addition to the Jewish bris milah retual.

But furthermore, rabbinic literature and secular accounts are full of examples of MBP killing babies. Here is a sample from the 135 years before penicillin became widely available. (This link will take you to a file on FailedMessiah.)

The University Of Pennsylvania has issued a statement on Agudath Israel Of America:

A review of available scientific peer-reviewed literature developed by our Center for Evidence-based Practice for physician information was recently cited by plaintiffs in a legal action against the New York City Health Department. The unpublished report was used without our knowledge or consent and importantly, without proper context. Further, a subsequent press release mischaracterized our review by implying that there is no causal relationship between circumcision performed with oral suction and the transmission of neonatal herpes simplex virus (HSV) when the full report on the existing evidence concluded this link does exist. Since our literature review, a February 2013 study published in the Pediatric Journal of Infectious Diseases, Koren et al, also supported this link based on transmission cases seen in Israel. In both our literature review and this latest peer-reviewed publication, the limitations of available evidence highlight the need for additional research, but because neonatal HSV can cause severe, life-altering illness or death in newborns, any risk factor that might expose a newborn to significant infection should be considered. It is regrettable that our evidence review was manipulated for purposes other than advising physicians of important clinical risk factors for newborns.
Penn Med could not be clearer – Agudath Israel of America used an internal Penn Med study without permission, took it out of context and misrepresented what the study found – in other words, the rabbis and gedolim of Agudah are outright lying.

My question is this; if this "study" was bought and paid for by a group with religious interests, then what other "research" is merely cooked data to support a religious view? What other "researchers" are purposefully failing to declare their conflicts of interest? And what other outrageous claims regarding circumcision are merely misrepresented words taken out of context?

NEW STUDY: Ultra-Orthodox Mohels Don't Give Babies Herpes



The number of reported cases of babies contracting herpes following their circumcisions, where ultra-orthodox mohels practice the obscure tradition of using their mouths to suck a child's freshly circumcised penis to "cleanse the wound," (AKA "metzitzah b'peh") has been increasing. Just the other day two more such cases made the news, and it is alleged that New York City hospitals and the city’s Department of Health are suppressing disclosure of even more cases.

But mohels putting their mouths on the wounded penises of children is not a health risk, claims Jewish group Agudath Israel of America , who has been fighting tooth and nail to get a new law requiring mohels report the risks of their practice to parents repealed. (They have been, as of yet, unsuccessful.) The law is basically worthless, as there aren't any real penalties, and it holds no one responsible, but the group wants it repealed anyway.

Agudath wants the New York law repealed, and this time, they've got "scientific evidence" to "prove" their tradition doesn't put children in any danger.

Well, at least the danger of herpes transmission.

Agudath has issued a press release lauding a study which they hope will vindicate a practice of what would otherwise constitute as neonatal pedophilia in other cases.

I find it rather comical that a religious group wants to vindicate a tradition with "research" ("religious freedom," it seems, is in itself, insufficient) as if the outcome of any "study" determines whether or not an act is morally justified; the act of slicing the penis of a healthy, non-consenting newborn is already sufficiently morally repugnant.

What do the outcomes of any "study" matter to people of faith anyway? Would Agudath seriously stop practicing their ritual had their "study" produced unfavorable results? I highly doubt it. Ultra-orthodox mohels continue to practice the act in spite of new regulations as it is. The infected babies are the evidence.

But Agudath continues to try and make the case that although babies have contracted herpes, their cherished tradition has absolutely nothing to do with it, the evidence and other research be damned.

They've got the "scientific proof," which I'm sure was conducted neutrally, and dispassionately, without any particular political goal in mind.

(Yeah right.)

Adugath Israel of America Appeals to "Research"
Reads the title of the press release:

"Ivy League Study Casts Doubt on Claims that Jewish Tradition Leads to Herpes in Infants
Jewish leaders praise independent study by Penn Medicine that found little evidence to support the claim that circumcision ritual is infecting infants"



 It appears "casting doubt" was the sole purpose of the "study," which I have a hard time believing is "independent." I'm sure Agudath has absolutely nothing to do with it.


"In a study published in December last year, University of Pennsylvania's Center for Evidence-based Practice reviewed several studies linking circumcision with oral suction, a common ritual for many Orthodox Jews, and herpes simplex virus (HSV) type 1. Though four published studies since 2000 suggested that such a link does exist, Penn doctors found the evidence to be 'small and significantly limited.'"

What do they posit is the cause for male babies contracting herpes following the ritual?

Who are the "doctors," and have they been investigated for potential conflict of interest? (IE, are they ultra-orthodox Jews who engage in the traditional practice? Are they in any way tied to Agudath?)

I keep hearing the word "evidence-based" thrown around, but that seems to mean a practice is justified as long as you have some sort of "study" that says it's OK.

Shouldn't medical practice be "needs-based?"


And what, pray tell, does religious ritual have to do with medical practice?


Four studies have been published since 2000 suggesting a link between a person putting his mouth on the wounded penis of a neonate is a risk for herpes transmission, but this one sets them all straight.

It doesn't seem to help by suggesting a causal link of its own though.

"The study was cited in an appeal filed Monday in the U.S. Second Circuit Court of Appeals challenging a New York City Department of Health (DOH) regulation that seeks to place limits on the practice.
'We have been saying for years that the evidence attacking this religious practice is highly dubious, and now we have world class doctors agreeing with us,' said Rabbi Gedaliah Weinberger, chairman emeritus of the board of trustees of Agudath Israel of America, a party in the suit."

Moral and ethical questions are moot as long as you have some sort of "study," it seems. But this reasoning doesn't always work.


"'We have been saying for years that the evidence attacking this religious practice is highly dubious, and now we have world class doctors agreeing with us,' said Rabbi Gedaliah Weinberger, chairman emeritus of the board of trustees of Agudath Israel of America, a party in the suit."

 Argumentum ad verecundiam; we don the white coat of science, therefore we are correct.

"'Hard scientific evidence simply does not back up the alarmist efforts of the New York City Board of Health and others who are needlessly interfering with the fundamental constitutional rights of thousands of New Yorkers.'"



Well.

At least ONE study doesn't back it up, and it's "hardness" is questionable.

"In the Penn study, the center explains that the evidence base is substantially limited by several factors. First, the number of events - some that date back to the 1980s - is too small to establish a causal relationship."

The number of reported events is small.

But most importantly, is a large number of events needed to establish a causal relationship when the causal link is clear?

How many babies must die in order to prove that they will drown if you hold their heads underwater for too long? Or that putting a plastic bag over a child's head will result in asphixiation?

"Second, the way the cases were reported led to many questions about their validity."

We are not given an example.

"Third, important information about some of the cases is unknown, specifically the infection status of the mothers, which suggests that the disease could have been transmitted in other ways."






Here, the "researchers" are attempting to place the onus on the PARENTS, while absolving the mohels.

And what about the important information that is known?

For example, the fact that at least one mohel that engages in the practice of oral suction of a wounded child's penis, one  Yitzchok Fischer by name, tested positive for herpes? And that three other children that he circumcised contracted herpes? One of whom died?


"'This evidence has important limitations. The total number of cases is very small and was distributed across three countries and a fifteen year time frame. As with all case reports, they were identified and selected in a non-systematic manner and cannot be compared with a specific control group,' the Penn review said in reaction to one particular study."

Sure you can.

1.3 million gentile boys are circumcised yearly in this country.

How many contract herpes via their mother?

How many contract herpes, period?


"Last year, the DOH passed a regulation requiring rabbis, as a condition of performing MBP, to inform parents that the DOH advises that MBP 'should not be performed' because of its alleged risks, and to obtain the parents' signed consent. The regulation thus expressly seeks to deter New Yorkers from participating in this religious practice."


But, as indicated by two recent reported cases, the law is basically worthless; an attempt by the DOH to look busy while shirking responsibility.


"Several rabbis and Jewish groups later filed suit, arguing that the DOH regulation violates both the U.S. and the New York State constitutions. By forcing rabbis to communicate the DOH's subjective advice that MBP should not be performed, along with equally subjective views about unproven health risks, the DOH is imposing its own beliefs on others and violating the rights of the rabbis."


Nevermind the beliefs imposed on a healthy, non-consenting child by permanently disfiguring his penis.


"Moreover, the suit casts doubt on the DOH's contention that undisputed medical facts show that MBP poses a risk, a contention now further undermined by the independent Penn study."






Well.

At least Adugath hopes...

"The Department of Health would have the public believe there is an epidemic going on, which is not only untrue but irresponsible," said Dr. Brenda Breuer, PH.D., M.P.H., an expert witness in the case."

Straw-man argument; the Department of Health is not trying to convince the public that there is any kind of "epidemic," going on, but is trying to respond to the fact that many babies have been infected with herpes following traditional circumcisions that involved the practice of the oral suction of freshly circumcised babies by rabbis.


"This is a procedure the Jewish community has been performing for thousands of years without an issue, and that has not suddenly changed in the last ten years."


What has changed, however, is people's willingness to keep deaths due to circumcision secret.

And, no, while the practice of brit milah may have been around for millennia, the practice of oral suction of the fresh circumcision wound of a newborn, AKA "metzitzah b'peh" is actually a relatively recent practice. (A good reference on how the circumcision as practiced by Jews has evolved over time is "Marked in Your Flesh," by Jewish anthropologist Leonard Glick.)


Conclusion
If the practice of placing one's mouth on the circumcision wounds of children isn't transmitting the herpes virus to them, then what is?

It seems vindicating what some view as a cherished tradition was more important than actually determining how exactly children are contracting herpes.

This "study" doesn't sound very scientific at all.

How are babies contracting herpes?

Aren't a mohel that tests positive for herpes, and the fact that the lesions appear around the child's genital area enough proof to conclude that the virus was transmitted via this practice?

Apparently not.

This doesn't seem to be a concern of the "researchers" or of Agudath.

Perhaps the practice of metzitzah b'peh hasn't changed in the last 10 years, but the act of keeping silent about these matters has. Just because people were failing to report these cases, does not mean that they weren't happening, it just means that 10 years ago, people were more willing to keep silent about these matters, and the times have changed.

We'll be hearing about how the practice of Metzitzah B'peh reduces the risk of cancer and HIV transmission next...

NEW YORK: Two More Herpes Babies, One With HIV


Two more baby boys have contracted herpes via ultra-orthodox Jewish practice of metzitzah b'peh, or sucking a newly circumcised child's penis with the mouth.

This time, one tested positive for HIV-1.

The New York City Department of Health deputy commissioner said it was "too early to tell" if the babies would suffer long-term health consequences from the infection.


I'm not sure what else to say.


CORRECTION:
The child in question did NOT contract HIV-1 as reported by Medical Daily. It was a misprint, as the child tested for HSV-1, which is the herpes virus.

This misprint is no excuse to ignore the incident; herpes being deliberately transmitted to children by otherwise intelligent adults is still a problem, and the New York City Health Department needs to stop shirking their responsibilities.

Another Mohel Botches a Bris


Whenever a botched circumcision case makes the news, and people start talking about it, either in the commentary section (when news outlets are actually brave enough to allow them), or parenting forums, or on Facebook, there is always somebody who says something along the lines of:

"This wouldn't have happened if it were performed by a mohel. Mohels are jacks of their trade who do circumcisions for a living."

Actually, mohels are often put on pedestals in more ways than one.

A Jewish bris performed by a mohel is better than a hospital circumcision performed by a doctor for a myriad of reasons. Here are some that I've heard:
  • Mohels are more experienced, so your son is sure not to suffer a botched job
  • Mohels take less time than doctors(some claim less than 10 seconds), shortening the painful procedure
  • Mohels don't use pain medication (this is supposed to be a good thing, in spite of the facts)
  • Mohels do their work outside of the hospital, in a religious setting, giving "meaning" to circumcision, making it more "holistic" ("holistic" taking on an entirely different meaning here)
There are other reasons, but these seem to be the main ones.

Now, there have been quite a few documented cases of mohels botching a bris, and being taken to court for it. (For example, here and here.)

But whenever I bring these up, strings and straws are grasped for, here and there, and Jewish circumcision advocates begin to list off alibis of why these are "special cases," and why mohels continue to be the best circumcision performers.

Among these are:
  • The child had a pre-existing condition; not the mohel's fault (when a child is found later on to be a hemophiliac, have a heart condition and other ailments)
  • The child had a particularly strange-shaped penis to work with; the case is an exception
  • The botch was a result of clamp malfunction; mohel is not at fault
  • The botch was performed by an inexperienced mohel; not a representative case
It's interesting to hear Jewish advocates of circumcision clarify that the bris has to be performed by a "trained and qualified mohel."

Thus, the reasons why Jewish circumcision performed by a mohel in a bris milah ritual are an ever moving target, and Jewish circumcision and its officiators remain sacrosanct.

Parents Usually Not Forthcoming
One of the reasons why very few botched circumcision jobs make the news is because parents, both Jewish and non-Jewish alike, are complicit in keeping the botched circumcision job and its perpetrator secret.

What parent wants to admit that their child has been permanently disfigured because they decided to agree to a medically unnecessary procedure?

In the case of Jewish parents, who wants to admit that what is perhaps the most precious of Jewish mitzvot is the cause of their child's disfigurement, and in worse cases, death?

As an example, when investigators were querying the Jewish families whose babies were infected with herpes, they would not name names. People in these communities were also unwilling to help find the perpetrator. The preservation of a cherished tradition that people have emotional attachment to is more important.

Circumcisors, Jewish and non-Jewish have reputations to protect. Gentile parents have peace of mind to preserve. Jewish parents have the added burden of protecting their own, and not giving away a holy man who performs the sacred ritual of bris milah. Thus, silence is perpetuated, and parents are complicit in keeping this silence.

That is, until now.

Circumcision Lawsuits
Recent years have seen a series of lawsuits against circumcisors, mohels and doctors, sometimes people who are both, for circumcision mishaps, which indicates that there are parents who are deciding to no longer keep silent about what has happened to their sons.

In a very recent case, a judge approved a $4.6 million settlement on a behalf of a boy who lost the head of his penis in a botched circumcision attempt. The doctor who performed the circumcision used a Mogen clamp, a device notorious for glans amputations, even when used by professionals. So notorious is the Mogen clamp for glans amputations that the company that makes this device went out of business, because it couldn't afford the $11 million dollar lawsuit filed against it, after a mohel severed the end of another baby's glans using one of their clamps

The peculiar thing about Mogen is that up until the very end, they claimed that injury was impossible with the use of their clamp, "when used properly," even after other glans amputations were reported. The injury behind a prior lawsuit at Fulton County Superior Court had already put Mogen on notice about the danger of the device. In a different case, at South Fulton Medical Center, another law suit was won in 2009. In that case, a child lost a third of his glans, and the plaintiffs were awarded 2.3 million dollars.

And, just this month, another mohel was taken to court by parents in Queens. The rabbi told the parents he did an "acceptable job" that was "performed appropriately" and "within the standard of care and skill required of Jewish mohelim and circumcisers." He also allegedly told the parents that calling a doctor wasn't necessary, even though it was obvious that something had gone wrong with the bris. The parents claim that the delay in medical treatment resulted in greater permanent damage to his son, resulting in the necessity for corrective surgery with general anesthesia; the boy may need more operations in the future.

Of course there will be those who claim that this would never happen if the circumcision were "properly performed."

To which I would retort that female circumcision does not result in complications "when properly performed" by the right shaman priestess either.

The self-serving, ad hoc special pleading is astounding.

Interesting note; Jewish groups are challenging a New York law that says mohels have to warn parents of the risks, and have them sign a consent form before proceeding. Does this mean that Jewish parents AREN'T being told of the risk of glans ablations, herpes infections and death?

Hopefully more parents, Jewish and non-Jewish, will find the courage to bring the botched circumcisions of their sons to light.

Rabbis Delay NYC's Metzitzah B'Peh Regulations - Meanwhile, in Israel...


After looking the other way for the longest time, the New York City Health Department finally decided to do something to address the issue of orthodox mohels spreading herpes through the practice of oral suction after ritual circumcision, also known as "metzitzah b'peh."

Or, at least, do something to look busy.

What did the New York City Health Department do to protect further boys from being infected?

They issued a mandate that would require parents to sign a consent form before allowing a mohel to perform metztizah b’peh on their sons.

According to Deputy Commissioner Jay K. Varma, the health commission would impose penalties at its own discretion. They would respond to public complaints and investigate the claims, (Because this has happened in the past? Do you seriously need a special law that requires parents to sign a waiver to do this?) and that repercussions could range from a phone call or a formal warning letter, to fines of up to $2,000 for each violation. (Again, when has this happened, and shouldn't this be standard procedure for ANY time a child is being put in danger? What happened in 2006 when Thomas Frieden was Health Commissioner?)

The mandate is basically worthless; there is no actual ban or regulation of metzitzah b'peh, and mohels would face no penalties whatsoever if the waivers were not signed. (I ask, what ultra-orthodox Jewish parent doesn't know the health implications of what is probably their most cherished religious tradition?)

But despite the new mandate being essentially impotent, ultra-orthodox rabbis were intolerant of what they see as an "unconstitutional, shocking governmental overreach." According to Rabbi William Handler, leader of Traditional Bris Milah, a self-proclaimed group formed to “protect Jewish ritual circumcision,” this mandate is "the first step in completely taking away traditional bris milah from the Jewish people in New York City.”

To prevent this mandate from taking effect, several rabbis and Jewish organizations, including Agudath Israel of America and the International Bris Association, filed a lawsuit at the Federal District Court in Manhattan. They accuse mayor Bloomberg of "blood libel," and the New York City Health Department of "trying to enforce erroneous opinions on the people of New York City." They claim the city lacks “any definitive proof” that metzitzah b’peh “poses health risks of any kind," despite the fact that the CDC found a total of 11 baby Jewish boys in NYC were infected with herpes.

Well, as they say, the squeaky wheel gets the grease, and it looks like the very vocal rabbis have gotten their wish.

New York City agreed to a brief stay in the enforcement of the above mandate, so that the plaintiffs who filed the lawsuit in Manhattan can submit a motion for a preliminary injunction.

The implementation of the city’s regulation, originally set to begin Oct. 21, has been pushed back until Nov. 14. 

Meanwhile, in Israel...
While rabbis were successful in holding back a law that does basically nothing to stop ultra-orthodox mohels from putting boys at risk for herpes transmission, the Israel Ambulatory Pediatric Association is calling for an end to the practice of metzitzah b'peh.

Going beyond a mere (and optional) waiver form as proposed in New York City, the Israel Ambulatory Pediatric Association is calling on Israel’s Health Ministry to require maternity wards and clinics to advise parents against metzitzah b’peh.

They are recommending that mohels, or ritual circumcisers, use a tube to take the blood from the circumcision wound, preventing direct contact with the infant’s incision.

Note the strange difference; in New York, officials want to take a "hands off" approach, going as far as highlighting the fact they neither ban nor are regulating how the practice is performed. In Israel, IAPA calls on Israel's Health Ministry to full on advise parents against the practice, and for the practice to be regulated.

Why an Israeli organization is displaying less reservation in regulating a Jewish religious practice than one in New York is beyond me. I would expect more for the Israeli organization to tread lightly on the issue, not the other way around.

Special Pleading
 The angry rabbis in New York try to act as if "religious freedom" is absolute, and government treats all religious practices as "off limits." Government intervenes in religious practices and beliefs all the time. Polygamy and child marriage is illegal, for example. In many states now, parents may not refuse to take their children to the hospital on the basis of "religious beliefs." And, since 1996, all forms of female genital cutting in healthy, non-consenting minors, including a "ritual nick" as proposed by the AAP in 2010, are punishable by law.

So while polygamists, perpetrators of child sex, circumcisers of girls etc., face the law, even in the so-called name of "religious freedom," circumcisers of boys get special kid-glove treatment, especially if they happen to be ritual circumcisers that put boys in extra danger by putting their mouths on the wounds they create.

Because pointing out the reality that cutting a child's penis and then placing one's mouth on it puts a child in danger and DOING something about it constitutes "blood libel," and would "upset" those who engage in the practice.

New York: Oral Mohel Tests Positive for Herpes


I've already written extensively on the subject of mohels infecting their subjects with herpes via oral suction.

Defenders of the practice have tried to argue that there is no way to know whether or not mohels actually gave their subjects herpes.

Well, now there is simply no doubt.

According to The Jewish Week, Yitzchok Fischer, one of the mohels who has been tied to several neonatal herpes infections has tested positive for the herpes virus.

'Nuff said.

The ball is in New York's court to act accordingly.

Mohels Spreading Herpes: New York Looks the Other Way


In a recent post, I talk about the second reported case, where a child dies as a result of contracting herpes from a mohel through an obscure circumcision ritual that is practiced only by ultra-orthodox Jews. The ritual in question is called "metzitzah b'peh", and it involves the mohel putting his mouth on the wounded genitals of a newly circumcised Jewish baby boy to suck blood from it.

Well, as I read more and more into it, the plot just keeps getting thicker and thicker.

The last time I heard, Yitzchok Fischer of New York was found to have infected three newborns with herpes via metzitzah b'peh, one of whom died. He was basically pardoned by Health Commissioner of the day, Thomas R. Frieden, and no further action was to be done regarding getting Orthodox leaders to abandon metzitzah b'peh. To prevent the transmission of herpes to other babies, the New York State Department of Health adopted a medical protocol in 2006, requiring ultra-orthodox mohels to wash their mouths with Listerine before performing the procedure.

Well, according to another recent report, the practice was rescinded less than a year later. According to The Jewish Week, Fischer was involved in the infection of yet *another* infant, who was admitted to a hospital with clinical diagnosis of neonatal herpes via oral suction in May, 2007. Based on that, the health department ordered Fischer to stop practicing metzitzah b’peh.

In my last post regarding this matter, I wondered as to the identity of the mohel responsible, and why it was not yet known. Authorities were investigating and the families involved weren't being to forthcoming as to the identity of the person responsible. I wondered if it was this self-same Fischer person whose identity people were trying to protect. Well, it looks like might have actually had reason to suspect. Apparently, despite his order from the health department to stop practicing the obscure oral suction ritual, Fischer is still performing it.

Only Two Out of Many
As I read more, I come to find out that while only these two cases have made the news, Haaretz reports that countless other deaths have not. And these are just the deaths; reports keep coming in of babies being admitted to hospitals for herpes infections with lesions around their genitals. You want to know why you hardly hear of complications due to circumcision? Well, this is why.

What is frustrating is that despite all the evidence piling up, mohels like Philip Sherman have the nerve to act singled out and "upset" that health authorities are doing their jobs.

"This is part of the anti-religious, anti-circumcision trend," Sherman blasts. 

"Across the board, the infection rate for circumcisions is less than one half of one percent... The baby could have gotten herpes from a relative or someone in the Hospital, or many other people... You can't say for sure it was the circumcision."

How long are practitioners of a deadly ritual going to be allowed to get away with denial?

All I've got to say is, the degree to which New York authorities are tip-toeing around the eggshells is getting to be quite ridiculous.

Children are DYING, and they're more concerned about "upsetting" the ultra-Orthodox Jewish community?

How long until they realize that this "tradition" is costing children their LIVES?

Sometimes traditions have to be abandoned.

This is a tradition whose time has come.

May one day this world be a safe place for children of both sexes, free of life-endangering "traditions."
